Who Can File a Personal Injury Claim? 

In North Carolina, anyone who can prove that they were injured and that their injuries were caused by someone else—whether another person, a business, a medical provider, a manufacturer, or some other entity—may have a personal injury claim. 

Most personal injury cases are based on negligence. To prove a negligence-based personal injury claim, you must prove the following:

  • You were injured, and your injuries led to measurable damages
  • Your injury was the result of someone else’s negligence or wrongful behavior
  • You did not contribute in any way to the incident that caused your injury

To have a solid case, you must prove that the other party against whom you are bringing the claim (known as the “defendant”) owed you a “duty of care.” This simply means that they had a legal obligation to take certain reasonable measures to prevent causing you injury or harm. By proving that the defendant acted negligently or wrongfully, you can show that the defendant breached the duty of care and is therefore liable for your resulting damages. 

What Are Damages? 

Damages are the remedy paid by the defendant to the plaintiff (the party who files the claim) to compensate them for certain losses they have suffered as a result of the defendant’s negligent or wrongful conduct. 

There are two main types of damages commonly awarded in personal injury cases: 

  • Compensatory Damages: As the name suggests, compensatory damages are intended to compensate injured victims for specific losses. These losses can be economic or noneconomic in nature and may include things like medical expenses, lost income, and pain and suffering.
  • Punitive Damages: Rather than compensating victims for specific losses, punitive damages are meant to punish the defendant. Such damages are usually only available in cases involving gross or egregious negligence, willful or wanton misconduct, or intentional infliction of injury.

Depending on the specifics of your case, you could be entitled to fair compensation for your past and future medical bills, lost wages or income, physical and mental pain and suffering, lost earning ability and future wages, and other miscellaneous out-of-pocket expenses. How Long Do You Have to File a Personal Injury Lawsuit? 

In North Carolina, you have just three years from the date of injury—or the date on which the injury was discovered or could reasonably have been discovered if it was not and could not have been discovered right away—to file your personal injury lawsuit. If the statute of limitations expires, the court will almost certainly dismiss your case.
