FAQ: How Long Will My Worker’s Compensation Case Last?

I’m Chris Hyland with Hyland & Padilla attorneys. A question that we get very often regarding worker’s compensation cases is: “How long is my worker’s compensation case going to last?” The answer to that is it does depend, and it depends on you, and it depends on how long you need to go to the doctor. Some cases are medical only, and a person will go to the doctor a few times, be better, be back at work, and that will be the end of the case. Other times, people need to go to treatment for a long time-years even. In North Carolina, under certain circumstances, if you keep going to the doctor, your case could stay open indefinitely for as long as you need to go to the doctor.

There are other situations where a client may want to settle their case even if they feel like they’re not completely healed, and so we can enter into clencher agreements, or we can enter into other awards that may or may not close the case permanently. The basic answer is it depends on our client, and you, and how long you need to go to the doctor, and the legal choices that you have once you’ve finished treatment, or if you’ve decided that you would prefer to settle your case.
