One of the questions that we get a lot is: “How long do I have to file a personal injury claim?” The statute of limitations in North Carolina is three years, so if you don’t file a lawsuit or you sell your case within three years after an auto accident, your claim legally will disappear. Other than that, you have as much time as you need. Sometimes, the insurance adjuster will tell people that if they don’t make a claim or if they don’t call the adjuster back that they’ll close the claim in a matter of weeks or days, or months. That’s not true. You have as much time as you need to go to the doctors, get better, and figure out what kind of treatment you need, so there’s no limit to filing a personal injury claim other than the three-year statute of limitations in North Carolina for auto accident negligence cases.
